Terms of Service

These Terms of Service ("Terms") govern your use of Powmetrix ("the Service"), a powder flowability prediction platform operated by C. Kossor. Please read them carefully before using the Service.

1. Acceptance of Terms

By accessing or using Powmetrix, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the Service, including organization administrators and members invited by an administrator.

2. Description of Service

Powmetrix is an online platform for predicting powder flowability. Users input material properties — including particle size distributions, densities, and surface energies — and the Service returns predicted flowability coefficients (FFC values) generated by a convolutional neural network (CNN) model.

The Service includes tools for single-material predictions, binary blend analysis, dry-coating simulations, and project-based workspaces for organizing prediction campaigns.

3. Account Registration & Organization Management

To use Powmetrix, you must create an organization account by providing a valid email address, a password, and an organization name. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Organization administrators

The user who creates an organization becomes its administrator. Administrators can invite additional members, assign roles, and manage the organization's materials and projects. The administrator is responsible for ensuring that all invited members comply with these Terms.

Account accuracy

You agree to provide accurate, current information during registration. You must notify us promptly if you believe your account has been compromised.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

• Attempt to reverse-engineer, extract, or replicate the prediction model or its weights
• Use automated scripts or bots to access the Service at scale without prior authorization
• Interfere with the Service's infrastructure, security mechanisms, or other users' access
• Upload malicious data designed to corrupt or manipulate prediction results
• Misrepresent Powmetrix predictions as certified laboratory results, official specifications, or regulatory submissions
• Resell, sublicense, or commercially redistribute access to the Service or its outputs without written permission

5. Intellectual Property

Your data

You retain full ownership of all material data, parameters, and measured values you enter into Powmetrix. We do not claim any intellectual property rights over your data.

Our platform

The Powmetrix platform — including the CNN prediction model, trained weights, source code, user interface, documentation, and brand — is the intellectual property of C. Kossor. These Terms do not grant you any rights to the platform beyond the right to use the Service as described herein.

Prediction outputs

Prediction results (FFC values, confidence scores, blend analyses) are generated from your input data using our model. You may use these outputs freely for your own research, development, and internal decision-making.

6. Prediction Disclaimers

Powmetrix predictions are generated by a convolutional neural network trained on published and experimental powder flowability data. While the model has been validated against measured results, you should understand the following:

• Predictions are estimates, not measurements. They should be treated as computational approximations, not as substitutes for physical shear cell testing (e.g., Schulze ring shear tester, Jenike shear cell).
• Model accuracy varies. Prediction accuracy depends on how well your material's characteristics fall within the model's training domain. Novel or unusual materials may produce less reliable results.
• Not for safety-critical decisions alone. Predictions from Powmetrix must not be used as the sole basis for safety-critical engineering decisions, regulatory filings, or process design where powder flow failures could cause harm. Always validate with physical testing.
• No guarantee of correctness. We make no warranty, express or implied, regarding the accuracy, completeness, or fitness of any prediction for a particular purpose.

By using the Service, you acknowledge that you understand these limitations and accept full responsibility for how you use the prediction results.

7. Data Contribution Program

Powmetrix offers an optional Data Contribution Program where you may choose to share anonymized material data to help improve the prediction model. Full details of what data is shared and how it is processed are described in our Privacy Policy.

License grant

By enabling the "Contribute to model improvement" toggle on a material, you grant Powmetrix a non-exclusive, royalty-free, perpetual license to use the anonymized numerical parameters (particle size percentiles, density, surface energy, and measured FFC) for the purpose of training and improving the prediction model. No identifying information is included.

Withdrawal

You may withdraw a material from the program at any time by disabling the toggle. Withdrawn data will be excluded from future model training cycles. However, models already trained on previously contributed data cannot be retroactively modified.

8. Service Availability

We strive to keep Powmetrix available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled or emergency maintenance
• Infrastructure failures at our hosting provider
• Security incidents requiring immediate response
• Updates to the prediction model or platform

We will make reasonable efforts to notify users of planned downtime in advance when possible.

9. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, C. Kossor and Powmetrix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Damages arising from reliance on prediction results
• Damages arising from service interruptions or data loss
• Damages arising from unauthorized access to your account

This limitation applies whether the claim is based on warranty, contract, tort, or any other legal theory.

10. Termination

You may stop using the Service at any time. To delete your account and associated data, contact us at [email protected].

We reserve the right to suspend or terminate your access to the Service if you violate these Terms, engage in abusive behavior, or if we reasonably believe your use poses a risk to the platform or other users. We will make reasonable efforts to notify you before or at the time of termination, except where immediate action is required for security reasons.

Upon termination, your right to access the Service ends. Sections 5, 6, 7 (license grant), and 9 of these Terms survive termination.

11. Changes to Terms

We may update these Terms as Powmetrix evolves. When we make significant changes, we will update the "Last updated" date at the top of this page and, where practicable, notify users through the application.

Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of the jurisdiction in which the operator resides.
